SIMULATED DAY SHOOTING TERMS & CONDITIONS 2020/21 SEASON
Agency
Crest Sporting Limited (trading as The Glorious Game Sporting Company) acts as agent for the above Estate. This contract, although issued on behalf of the Estate by Glorious Game, is made by you directly with the Estate. This means that the Estate accepts direct responsibility under these terms for its commitments to you, including responsibility for what Glorious Game does as its agent.
1. Cost and Payment Terms
The price will be confirmed when the number of guns is confirmed. Per person prices are £285+VAT for teams of eight-ten guns or £260+VAT for teams of eleven to sixteen guns. There are further costs for gun hire, cartridges, and instructors as detailed in clause 7.
If the contract issue date is on or prior to 1st March 2020 the accompanying invoice is for 50% price of the shooting, and is payable within 30 days. The second invoice (for the balance) is sent on the 1st March and is payable within 30 days of the full sum is due at least 14 days before the date of the shoot. Any supplementary invoices sent to you (for example cartridges, hire guns or if extra drives are requested) must be paid within 14 days. No
All payments must be made to Glorious Game, which accepts payment as the agent of the Estate. You will see from the invoice that the price is in UK pounds sterling. This is the net amount which the Estate must receive, and therefore you are responsible for sending sufficient funds to Glorious Game to allow for costs of conversion of foreign currency into sterling.
Payments should be increased to take account of deductions made by, for example, by your transmitting bank .Direct bank transfers should be made to Glorious Game account. We regret that we can not accept bankers’ drafts and cheques.
You must (unless there has been a mistake) pay the full amount of each instalment by the appropriate day; otherwise the Estate may cancel the booking (see below). The Estate may alternatively (at its option) charge you interest on outstanding sums from the due date until payment, at a rate of 8% per year. If you think the estate or Glorious Game has made a mistake, you must notify Glorious Game immediately. Once Glorious Game have remedied a mistake (by sending to you a revised invoice) you must pay the total amount of the revised invoice.
2.Changes or cancellation by you
You may cancel this contract without penalty within 14 days of the date of this contract, and if you do so the Estate will refund all payments made by you. After this the provisions listed below will apply to any change or cancellation which does not result from mistakes by the Estate or Glorious Game.
If you wish to cancel shooting days, or the entire contract, the Estate will endeavor to resell the shooting days through Glorious Game. Failing re-letting, you shall remain liable for the full Price, or any shortfall between the full Price and the sum at which the shooting may be re-let.
Cancellation means that the estate will lose the time it and Glorious Game have spent on your booking, and so they will be entitled to keep a £500 charge to cover this. You will also be required to pay £150 + VAT to each loader you have booked, if they are cancelled within 48 hours of the shooting day.
3. Cancellations and exclusion (of persons) by the Estate
In the following circumstances the Estate will be entitled to prohibit members of your party from taking part in the shoot, without obligation to refund price or to pay any losses or costs suffered as a result:
If a member of your party fails to meet all the legal requirements;
If a member of your party is acting in an unsafe or irresponsible manner.
The Estate will be entitled to cancel any day’s shooting:
Due to adverse weather conditions. This will not affect the Estate’s right to be paid what is owed in full under these terms, and we would expect that you would recover this under Glorious Game refund agreement subject to the stated terms and conditions as set out in clause 8.
Because of factors which can reasonably be considered to be outside the Estate’s control making it unlikely that the Estate will be able to comply with its obligations (examples are when it is inadvisable to, or restrictions have been imposed on, travel or use the land/estate because of disease, or unrest, or because of political or industrial relations activity). Where applicable, the Estate will try to offer to you suitable alternative dates later in the season, but if this is not possible then the Estate will refund the day charge price to you. In these circumstances the Estate will not pay any costs or losses you suffer because of the cancellation. Glorious Game‘s administration charge is non-refundable.
The Estate will try to give as much advance notice of cancellations as possible, explaining the reasons.
4. Liability
Because Glorious Game is only the agent of the Estate, it is not responsible for the Estate’s commitments under these terms or for anything else that the Estate does or does not do. However the Estate is responsible for what Glorious Game does as its agent.
Glorious Game hereby disclaims all warranties, terms and conditions with regard to the services provided hereunder, including all implied warranties, and conditions, of suitable quality and fitness for a particular purpose.
The estate and other suppliers providing shooting, travel or other services for Glorious Game are independent contractors and not agents or employees of Glorious Game and Glorious Game is not liable for the acts, errors, omissions, representations, warranties, breaches or negligence of any such suppliers or for any personal injuries, death, property damage, or other damages or expenses resulting therefrom. Glorious Game shall have no liability and will make no refund in the event of any delay, cancellation, overbooking, strike, force majeure or other causes beyond its direct control, and it shall have no responsibility for any additional expense, omissions, delays, or acts of any government or authority.
In no event shall Glorious Game and/or its suppliers be liable for any indirect, incidental, punitive, special, or consequential damages arising out of or in any way connected with any services obtained through Glorious Game or arising on connection therewith, (including, but not limited to loss of use, data, profits, savings or opportunities), whether based on contract, tort, strict liability or otherwise, even if Glorious Game and/or any of its suppliers have been advised of the possibility of damages. Except in relation to liability for death or personal injury for which no limit applies, Glorious Game and/or its respective suppliers shall be liable for direct loss arising in connection with the services, whether based on contract, tort, strict liability or otherwise, up to a maximum of the total value of the charges paid by the Client for the services under which the claim arises for any one event or series of connected events. This does not affect your statutory rights as a consumer.
The Estate will accept all liability if something it does causes death or injury. Subject to the limitations below, the Estate also accepts all liability for damage to the property of any member of your party if the cause is the Estate’s fault i.e. the Estate breaks the contract or is negligent or commits some other breach of a legal duty. Otherwise the shoot is entirely at your risk.
If the Estate breaks the contract it is responsible for any losses or costs you suffer if they are a foreseeable consequence of the Estate breaking the contract. Losses are foreseeable where they could be contemplated by the Estate and you at the time of the booking. The Estate is not responsible for indirect losses or costs which happen as a side effect of the main loss or damage and which are not foreseeable by the Estate and you. (Such as a business loss of a member of your party, like loss of profits, loss of opportunity or other economic loss).
5. IMPORTANT – Legal requirements
All members of the party should have a current UK Shotgun Certificate or Overseas Visitors Shotgun Permit and produce them to the shoot manager on the first day of the shoot. If they don’t have one then it is your responsibility to immediately inform Glorious Game, as agent of the Estate.
The Estate may exclude from the shoot any member of your party who is unable to produce this documentation, and this will not affect the Estate’s right to be paid what it is owed in full under these terms.
The Estate has no objection to any member of your party engaging Glorious Game to assist him/her in obtaining the necessary certificate/permits, and suggests that is done as soon as possible.
6. IMPORTANT – Safety
Safety is paramount.
It is not the Estate’s responsibility to decide whether the members of your party or their firearms are fit to shoot, and you must ensure that this is the case. If any member of your team has not had at least 10 days of driven game shooting experience then you must inform Glorious Game or the estate prior to your day. Such persons must have an estate loader or instructor with them throughout the day. Members of your party must not shoot if they are suffering from any serious medical conditions, or have recently undergone surgery, or are under the influence of alcohol or drugs.
All members of the party must:
Be familiar with and comply at all times with the Code of Good Shooting Practice 2008 (this can be found at http://www.countryside-alliance.org.uk/images/stories/pdf/2008_code_good_shooting_practice.pdf);
Take part in the safety briefing given on the first day of your shoot;
Promptly comply with all instructions given by the shoot manager, whether in the safety briefing or later.
The Estate may refuse to permit any member of your party to participate or continue to participate in the shoot whose conduct is dangerous or irresponsible or whom it suspects will act in such a manner, or who is otherwise unfit to participate in the shoot. The Estate has such a right irrespective of any insurance cover held by such a person. If such a person is excluded from the shoot, then this will not affect the Estate’s right to be paid what it is owed in full under these terms.
7. Services to be provided by the Estate
The Estate will, subject to these terms, permit your party to participate in the shoot held by it on the land/estate identified above.
The estate will provide:
A simulated driven day with five drives and where 2,500 clays are put over each eight gun team;
A safety briefing for all members of your party;
Coffee and bacon rolls on arrival;
Elevenses; and,
The Estate will appoint a shoot manager who will be present at the shoot throughout the day, and will direct the shooting.
The Price does not include:-
Four –wheel drive transport on the shoot;
The provision of guns or cartridges;
Gratuities to the trappers;
The provision of loaders.
If you wish the services of a loader, then Glorious Game will be happy to arrange this as agent for the Estate. However, you will be responsible for the loader’s remuneration
If you wish to purchase cartridges, hire guns or ear defenders for use on the shooting day, Glorious Game will be happy to make arrangements with you as agents for the Estate at the following rates:
Gun hire £70+VAT per gun
Instructors £125+VAT per instructor
Cartridges £70+VAT per 250
8. Insurance
If you have agreed, as shown on the attached invoice, to be covered by Glorious Game refund agreement for cancellation due to adverse weather then the refund policy is as follows:
A refund would be made if by 11.00am on the day of the shoot, not a single shot was fired as a direct result of adverse weather conditions (meaning unfavourable atmospheric conditions such as temperature, fog, cloudiness and rainfall affecting the shoot event at the specified venue on the particular booked day, such as to render shooting unsafe impossible. This does not include the consequence of extended adverse weather conditions affecting for example, but not limited to, the condition or numbers of game or the state of feeding grounds.) or if the day was unable to start before 11.00 am and was terminated as a direct result of the actions of an organised protest group (meaning a planned and controlled public demonstration involving a number of people expressing an ideologically motivated objection to the shoot).
Please note the following:
The Shoot Captain responsible for running the day’s Shoot shall be the sole judge of whether the Shoot can or cannot take place and his decision shall be accepted as final and binding by all parties.
No decision to cancel may be taken prior to 11.00 .a.m. on the day concerned.
In the event of a cancellation the shoot party shall submit a statement giving the reasons for cancellation, the time the decision to Cancel or Abandon was taken. The statement shall be signed by both the shoot captain and the person who takes the decision to cancel the Shoot.
If you have started shooting and at 11.00 a.m. the person responsible for the Shoot considers it necessary to Interrupt the Shoot for a while, but not to Cancel or Abandon the day, and the Shoot is, or could be, resumed later on, liability shall be reduced by one third following each drive which does take place, or which could have taken place had the Participants elected to do so.
Each gun on the day has third party liability up to a level of £5,000,000, but the cover is conditional upon the gun having at least two year’s experience of shooting or being accompanied at all times whilst shooting by a member of the party who has at least two year’s experience in shooting i.e. an estate loader or qualified instructor who possess a UK Shotgun Certificate. Please ask Glorious Game for a copy of the policy, if required.
9. Law
The Parties agree that this contract shall be governed by the laws of England and that any disputes arising out of or in connection with this contract shall be subject to the exclusive jurisdiction of the courts of England
10. These Terms
The Estate intends to rely upon the written terms set out here. You must not rely on promises or claims written or verbally made by anyone other than the Estate or Glorious Game, and it is recommended that you promptly confirm any verbal promises or claims in writing to Glorious Game. In that way, we can avoid any problems surrounding what the Estate and you (the customer) is expected to do. Payment of all or any part of the day charge/s as referred to in clause 1 shall constitute acceptance of these terms whether or not these terms have been signed and returned to Glorious Game.
11. Data Protection
Glorious Game and the Estate will use your details and those of the members of your party in connection with the organisation of your day's shooting. Glorious Game and the Estate will not pass these details to third parties. Glorious Game and the Estate may use the details to notify you of events if they think these could be of interest to you. If at any time you want to be removed from Glorious Game and the Estate's databases please contact Glorious Game.

Deer Stalking Terms & Conditions: 2020
1. Deer Stalking will take place on dates previously agreed and will be under the direction of Glorious Game Sporting Company (GGSC)’s managers/employees. Their decision is final.
2. Each guest will be required to shoot their rifle at a target in order to zero the rifle and demonstrate competence and accuracy. The Stalker has the right to refuse to take any guest on an outing should they fail to demonstrate their competency.
3. You will be responsible for ensuring each gun has public liability insurance with a minimum cover of £5 million. This is usually arranged through a standard membership of the Countryside Alliance or BASC.
4. An estate rifle may be made available by prior arrangement. If you are shooting your own rifle it must comply with minimum legal requirements.
5. You must accept that you will not be permitted to shoot deer unless we are satisfied that you are competent and fit to do so. We reserve the right to send you home without refund if safety is infringed or inhumane shots are attempted.
6. High seats are maintained to a high standard but guests must accept that they use them at their own risk.
7. Any resulting venison remains the property of GGSC unless otherwise agreed.
8. During a stalk outing or on one of our training courses, you may be loaned/hired equipment to use such as stalking sticks, binoculars or knives. There is a fee of £100 +VAT per day for stalking equipment including hire and binocular hire.
9. Ammunition can also be purchased separately subject to calibre, availability and any restrictions on your firearms certificate.
10. Whilst the equipment is in the possession of the client during the loan period, the client accepts all risks for personal injury, public liability, personal liability and / or damage to property related to the use of the loaned equipment. In the event that any item of loaned equipment is damaged, the cost of repair or replacement will be charged to the client.
11. If an animal is deemed to be wounded or potentially missed all stalking will stop until all possible attempts have been made to locate the animal. In circumstances where the animal is not found and the Glorious Game guide judges that the animal has been wounded, 100% of the applicable success charges or estimated trophy fees and venison will be payable by the client.
12. It is a requirement of your booking that you inform us of any physical ailment which may affect you during the course of the hunt.
13. Fees & Charges
(i) Introductory session
An introductory session is £350 + VAT. This session is based on approximately two hours on the range, plus ammunition, plus a ‘mock’ stalk. Equipment hire and 20 rounds are included in the base price. If a shot is taken at an animal or an animal is culled there is an additional fee of £125 + VAT.
(ii) Standard outing
The cost of a morning or evening outing depending on requirements, is currently £250 + VAT. This excludes gun/equipment hire, cull or trophy fees.

15. Official CIC Measuring fee
If trophies are CIC Assessed, the measuring fee is £55 + VAT per trophy, this excludes any trophy preparation or taxidermy fees.
16. Cancellations & Bad Weather
(i) 100% of the outing fee is due upon booking an outing, stalk session or firearms training.
(ii) Cancellations of less than one week (7 days) will incur 100% of the total outing fees.
(iii) Gift vouchers for stalking and courses are non refundable.
17. By accepting stalking or by attending a stalking outing you are deemed to have agreed to and have complied with these terms & conditions.
